Terms of Service

By accessing or using Helium (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use Helium. These terms apply to all users of the Service, including mobile, desktop, and web applications.

Helium is a cross-platform application for capturing, organizing, searching, and reusing valuable outputs from AI conversations. The Service includes local storage, cloud synchronization, AI-powered features, prompt sharing, and data import/export capabilities.

Helium works offline without an account. Creating an account unlocks cloud sync, sharing, and AI features. When you create an account:

• You must provide accurate and complete information
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must notify us immediately of any unauthorized access to your account
• You must be at least 13 years old to create an account

We support sign-in via Apple, Google, GitHub, and email/password. You may have only one account per person.

You own your content. All cards, prompts, conversations, context profiles, projects, tags, screenshots, and other content you create or import into Helium remains yours. We claim no ownership or intellectual property rights over your content.

You grant Helium a limited, non-exclusive license to store, process, sync, display, and transmit your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or your account.

You are responsible for ensuring you have the right to store and use any content you add to Helium. Do not upload content that infringes on others' intellectual property rights.

Helium offers a free tier and a paid Pro subscription:

• Free tier: unlimited cards, prompts, and conversations; full-text search; cloud sync on the iOS app (iPhone and iPad); 5 AI captures per day. Conversation import (ZIP, JSON, share-link) is free; AI features beyond the daily capture quota require a Pro subscription.
• Pro ($7.99/month or $59.99/year): AI auto-crop on screenshot capture, conversation summarization on import, link AI tools (distill, summarize, extract), context management (compress and synthesize), auto-suggestions for My Context, and 100 AI captures per day (vs 5/day free).

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Payments are processed by Apple via the iOS App Store, with RevenueCat managing subscription entitlements between Apple and our backend. Refunds follow Apple's refund policy.

We never see or store your payment details. Prices are in USD and may vary by region due to platform policies.

You agree not to:

• Store, share, or distribute illegal, harmful, or abusive content
• Attempt to access other users' data or accounts
• Use automated tools to scrape, crawl, or abuse the Service
• Circumvent rate limits, free tier limits, or security measures
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use Helium to build a competing product
• Share prompts containing malicious instructions, phishing content, or malware
• Resell or redistribute Helium Pro access

Violation of these terms may result in immediate account termination.

When you share a prompt publicly:

• Anyone with the link can view a preview and import an independent copy
• Your identity is never shown on the public page
• You can revoke sharing at any time, which removes the public page
• Copies already imported by others are not affected by revoking
• You are responsible for ensuring shared prompts do not contain harmful or infringing content

Helium uses Anthropic's Claude API for AI-powered features. By using these features, you acknowledge:

• AI outputs may be inaccurate, incomplete, or misleading
• You should not rely solely on AI-generated answers for critical decisions
• Your content is sent to Anthropic for processing but is not stored or used for model training
• AI features are subject to rate limits and may be temporarily unavailable
• Helium is not responsible for decisions you make based on AI-generated content

The Helium name, logo, design, code, and documentation are the intellectual property of Helium and its creators. You may not copy, modify, distribute, or create derivative works of the Service itself.

Your content belongs to you (see Section 4). The distinction is clear: we own the tool, you own what you create with it.

By you: You can delete your account at any time via Settings → Account → Delete Account, or by emailing [email protected]. We recommend exporting your data first. Deletion is permanent.

By us: We may terminate or suspend your account immediately, without prior notice, if you violate these terms or engage in abusive behavior. We will not terminate accounts arbitrarily.

Helium is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times. While we take reasonable measures to protect your data, we cannot guarantee absolute security.

To the maximum extent permitted by applicable law, Helium and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising from:

• Your use of or inability to use the Service
• Any unauthorized access to or alteration of your data
• Any AI-generated content or its accuracy
• Any third-party service failures (Supabase, Anthropic, RevenueCat)
• Any data loss, despite our reasonable precautions

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We may update these Terms of Service from time to time. For material changes, we will notify you via the email address associated with your account at least 30 days before the changes take effect. The “Effective date” at the top of this page reflects the latest revision.

Continued use of Helium after changes take effect constitutes your acceptance of the revised terms.

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the courts of the United States.
